If swarming termites are discovered (after a big rain) in the garden area, but there is no evidence of termites inside the condo unit, who is responsible for an inspection and termite treatment? (board or owner)

Since the termites start from outside usually a community owned element, then the HOA is responsible.
Usually a visual inspection for termite tubes is a tell tale sign of termites.

There are come condo boards who try to pass termite infestation costs to individual unit owners, but in most condos the cost for inspection and extermination is a common expense. Boards try this be cause they haven’t budget for the expense, they have failed adequate reserves, they don’t want to raise fees and they think they can run over a few owners.

Termites swarm every year.

The fact that you saw a swarm does not require an inspection.

Inspections should occur on a scheduled basis.
If your Association is doing this, and you are concerned because of the swarm and want an inspection, the cost would be on you.
