Harassing neighbors that make false accusations.

Hi, I live in Arizona. I own a house in my name only. My boyfriend is not on the deed. There is no HOA yet. My boyfriend told a neighbor that he was feeding pigeons . He did not realize that it was illegal in Arizona so he stopped feeding them. The next door neighbor complained to the Dept. of Health about it. They came and inspected our backyard and found the complaint to be invalid and provided us with a letter to confirm this. This neighbor got a few of our neighbors to complain about him feeding the pigeons to the Health Dept. A few months later after the Health Dept. first came to our house somebody else again complained. They are making false accusations that he is feeding pigeons in our backyard and he is not. The Health Dept. came and again said the complaint is invalid. I want to avoid my neighbors from making false allegations against him. What can I do? Also, when the development becomes an HOA which should be shortly and if the neighbors start making false complaints to the HOA , what can I do? The neighbors can not see into our backyard since the fences are high and not transparent (made of blocks).There are a few neighbors that do not like us and are making false complaints with the Dept. of Health. I have an upcoming appointment with a lawyer but want to hear about everybody's comments.

Welcome to the forum. I would like to offer my opinion on a few items you mentioned in your post:

1) If you are making monthly or annual payments to the developer, their is an HOA. The HOA is simply being ran by the developer and not the membership. Your governing documents will explain when control of the Association would transfer to the members.

2) It does not matter who is or is not on the deed. If individuals live in the house, the owner is responsible for the actions of those individuals. Be prepared for that when control transfers over to the membership (especially if the group you believe dislikes you serve on the Board).

3) It can certainly be frustrating when one is accused of something they did not do. Fortunately, the complaint is being verified as false and you are given documentation about it. Worst case, this is something you may have to live with within that development. I'm not saying you should have to live with it, I'm saying that this is life and you may have to live with it.

4) The question becomes why are those around you complaining?

You believe it's because they don't like you, your boyfriend or both.

Keep in mind that it may simply be that their are a lot of pigeons and individuals are tired of the roosting and the mess that is being made on their property and they believe your house is the reason why the pigeons are hanging around and does not have to do with liking or disliking your household. If this is the case, you may want to perform an internet search on how to keep pigeons away.

5) How to stop the false accusations:

You might never stop it from happening. You may be able to minimize it by getting to know your neighbors. This could be done by:

a) inviting them over for burgers and beers one afternoon
b) Perhaps by holding a wine and cheese party.
c)Perhaps by asking the dept of health to come in and give a talk on how to deter the pigeons to you and your neighbors.

Harassment is unwelcome behavior that demeans, intimidates, or humiliates another person, and can be verbal, physical, or social.

Calling a government agency and requesting they investigate a suspected violation of law is not harassment. It’s the way our system of government is supposed to work.

If people were calling you and stating if your BF doesn’t quit feeding birds, we are going to take matters into our own hands and do something about it, that’s harassment.

One neighbor riled the other neighbors to start calling the Dept. of Health to make these accusations to be malicious and vicious. These people have called the Dept. of Health multiple times and are not stopping. This is slander and libel. I already spoke to a lawyer and I definitely have a good case. I have a lot of proof.

Good luck to you. Continue to gather evidence (time and date stamped photos, etc.) And be sure you request reimbursement of all legal fees and expenses you incurred in pursuing this in court if it comes to that. Some people need a smacking in the wallet before they finally behave.

Some people need to be counter sued so the understand the real price of poker.

I do not know what you are trying to say since if nobody is doing anything wrong it is not necessary for a countersuit. I have already covered all of my bases and I have a 100 pct win.

In Arizona uou have no case unless you can show that financial harm occurred to your boyfriend.
