This was a first. Our director election was last week. The meeting was entirely on Zoom. The ballot count was not done in person but on Zoom. The president decided to start the board meeting agenda while the ballots were being counted. Of course that meant no director could watch the ballots being opened or counted.

Proper notice of the member meeting and the board meeting were given but the member meeting was not adjourned, they were conducted at the same time, and we couldn’t observe the ballot opening/count because we had to pay attention to the board meeting.

If you want people to attend meetings and serve on your boards, you have to be respectful of their time and to conduct member meetings in a an efficient manor. It is not abnormal for a committee to count the ballots while the meeting progresses at either in person or zoom meetings.

Board members are volunteers. Why anyone would serve on an HOA board in CA where they make volunteering as difficult as possible is baffling.

Our election laws are consumer protections. Directors/officers who don’t appreciate that are a threat to consumers.

So once again, your president did whatever he wanted and the rest of you (the board, that is) did....what?

Was there a discussion before the meeting on how people could observe the ballots, perhaps have it done live (where people could attend and watch) and the counters announce each vote, as in "one vote for Terri" (obviously you won't announce who voted for who)? Or just make the member meeting live and the board meeting virtual - let people know which is which and they can decide how they'd like to attend.

If you were re-elected (or even if you weren't or decided to not to run), you can bring this up in the next resident forum at the next board meeting, but as everyone has said here, you and your neighbors have options if you want to stop this. We know how you feel, but apparently the rest of your neighbors don't feel the same way. I know it can be disheartening to watch because this can lead to something even worse happening, but sometimes that's exactly what has to happen before people wake up.

We were all blindsided because this had never happened before. I attribute the acquiescence to lack of knowledge. We are actually making some progress.
There was no discussion, the inspector of elections was just another little window in Zoom. I will make sure everyone knows all members have to be able to watch even if directors have little kids that need attention.
I wasn't a candidate but I was elected secretary and I said I would serve as long as the board backs me up to do everything required in the bylaws...and the president says "within reason." So that will be another challenge.

A consumer is person who purchases goods and services for personal use. As an owner in an HOA, you expect free services from the people serving on your board and want to regulate how those free services are delivered.

Where else under capitalism does that work well?

I purchased an undivided interest in all the Association's common areas. And every year I pay assessments for their maintenance. The board members have a fiduciary duty to care for my purchase by using funds wisely and avoiding risk to the association by following election laws.

She is not 'regulating' anything. The law and the covenants do the regulating.

I am sure you do, you still aren’t a consumer of board services because you are paying for those services. Anytime a legislature makes life more difficult for a volunteer HOA board, they discourage HOA board participation by an owner.

The recent legislation on FL requiring board training is a great example. A lot of people aren’t going to take time from their children, fishing or golf to put up with at BS.
