If the wife's name is on the deed and the husband's name is not. Can the husband be on the Board?

Big question...

BruceR1 - IF the governing documents state that in order to be a member of the association one must be an owner, and that only members of the association can be Board members, than the answer to your question is NO. The husband's name is not on the deed, therefore he is not an owner, and therefore not a member. He is a resident, a husband, and probably considered an association member with the right to use the common facilities and enjoy everything a member can except vote. If someone can't vote then they can't be on the Board. In other words, look to your governing documents and see what the requirements and definitions of members are. It is a big question and only your gov. docs. can answer your question.
