My neighborhood in MD is divided into 12 parcels. Out of those 12, only 2 have been turned over to our HOA Board. Our HOA Board has existed since May 2023. We have been paying for the landscaping for the entire community up until last year, when we were informed that we should only be paying for the two parcels that we own. I’ve looked everywhere including our bylaws which are very vague. I’ve pulled property records and they show active permits under the developer. So my question is who is responsible, the HOA Board or developer?

A lot of odd things going on.

1. Normally a developer does not transfer control of an HOA until after the development period has expired.
2. During the development period, the developer typically has multiple votes for each lot tge own.
3. There is usually no landscaping on undeveloped lots, but the common areas require landscape services.
4. If you do have control of the HOA, you need to have an attorney examine your declaration. Developers are known not to pay their required
