Hi all,
I'm on the Board of a 17-unit condominium building in CA. We have CC&Rs AND Rules & Regulations for the community, but no fines attached to violating any of those rules.
It's a simple community - no pool, roof deck, or gym, but obviously have rules governing community space, how to deal with trash and recycling, etc.
We've discussed publishing a schedule of fines attached to rules violations but have no point of reference. Can anyone share what their community uses that we can refer to as a jumping off point?
Thank you!
Stasia

StasiaR, does your board understand from where the authority to impose fines comes? If not, then as a starting point, review https://www.davis-stirling.com/HOME/F/Fines-and-Penalties, under the section titled "authority to fine."

In California, as long as the HOA's governing documents give the board the authority to create (reasonable) rules, then the HOA can impose reasonable fines to enforce those rules.

California statutes are strict and detailed about the notice required, hearings et cetera required to impose fines (which are essentially new rules). If you have not already, do consider studying the Davis-Stirling.com's discussion of these subjects.
