I saw a previous post about forclosures, but it wasn't exactly what I needed to know.

We have been served with 2 summons that are about foreclosures. It says we need to respond w/in 20 days, and file some paperwork with the clerk of courts. The homeowners are behind in their assesments, but no liens have been filed as of yet.
The last pres. was served in Oct. and did nothing, do we still have a claim?
What do I do?
What paperwork needs to be filed?

You need to have you PM make contact with your HOA attorney and confirm that they did not file a lien. If they have not filed make sure the proper paper trail was followed before requesting they send the letter of intent. You can still file the lien, as well as forclose on the lien, you will fall in line behind others that have already filed and or have forclosed. You may or may not get the monies owed to the association.

we don't have a MC or PM. We're self managed, I also tried to contact our lawyer, but he's not at that firm anymore, so I'm not sure what to do. I need to hire a new lawyer, but we have to get the board together and decide, meanwhile times ticking on the 20 days deadline.
