Previous board sent down a special assessment without a 2/3 vote of the community, when our docs specifically state that in order to pass an assessment, we need a 2/3 vote.

What could we do (if anything) about that?

The new board should declare the action of the old board null and void.

Then they can declare the monies received as a credit on the new assessment that has been done properly. I assume the need for the first assessment is justified. If you don't correct the error, you might find that somone will just not pay it. If you don't need the assessment, credit the money collected already to the appropriate households.
