Can a HOA put on their website their marketable title record that includes everyone’s name and address, especially without asking permission to do so? I have strong feelings about my private information be shared so publicly. Thank yiu

In Michigan I see no signs that this violates the state criminal statutes.

However if you wanted to sue for invasion of privacy, you would have to show that you suffered specific financial harm (damages), and the showing would have to meet a certain legal standard. The standard is very, very high.

Consider writing the board a letter stating that you feel this action may hold the HOA out to litigation. In this time where insurers are looking for excuses to cancel or not renew policies, is it really necessary to put information on the HOA web site that could lead to litigation? Make it clear you are not going to sue. You are "just saying" that the risk does not seem to justify the benefit.

Probably, but I think the shouldn't.

Most property records are available online anymore.

My suggestion: Ask the board that they place that information on a private side of the site.

If your name and mailing address were private information, you would have a valid objection.

Normally any owner in an HOA may request any owners name and mailing address from the HOA. Many HOAs will not release phone numbers or email addresses. Some states require all the contact information be released.

Additionally your name and mailing address are public information and usually available from your county online. Anyone may simply search your name.
