Hi Everyone,
I currently live in a condominium located in Florida and we just received notice of a special assessment. We have valet and some residents would like to keep it and some would like to remove it. Can I create a petition to remove valet and if yes whats verbiage should the petition reads.

1) you need to identify what document states that the association will provide valet service.
2) you need to read what is needed to amend that document
3) you need to identify (perhaps in corporate law) how many units need to sign a petition to call a special meeting of the membership.
4) Your petition should then read something along the lines of:

We the undersigned owners representing ___ percent, or more, of the units in the Association The undersigned members hereby petition the board of directors to set the earliest reasonable date, time and place for a special membership meeting of the membership for the purpose of __________________________________

Printed name, signature, unit number, date

The first ____ should be based on how many units are needed to call a special meeting

The second ________ is:

a) amend the xxxxxxxxx to remove the provision of providing valet service
b) voting to keep or remove valet service

b) is basic wording if no document requires the service be provided and it was simply a board decision.

That would be considered a request which the board can consider and dismiss.

That would be considered a request which the board can consider and dismiss.

So you think the best solution is to call a special meeting and overrule the board before you presented any evidence the owners would like to eliminate the valet and present it to the board for their consideration?

I'm simply pointing out the difference between the two petitions.

Lets face it, the membership is limited on their authority.

In all associations the membership can:

a) elect directors
b) vote to amend governing documents
c) vote to recall directors
d) call a special meeting of the membership for a specific purpose
e) vote on specific issues brought by the board before the membership

In some associations the membership can also:

f) ratify the budget
g) vote for special assessments
h) vote for raising assessments
i) elect officers
j) sell or buy association property

That is it. This is based on corporate statutes that give power to the board to run the affairs of the Association

Valets are associated with luxury condominiums. Rather difficult to live in a luxury condominium with no services.

Yes, the only two high rises a near mine the not only off er but require valid parking of residence car are indeed "luxury." Since evidences must use valet parking, I', guessing it is in their CC&Rs .

There are occupants at one whom I know who do not like valet parking one bit.

I believe that valet is probably listed in your documents as an amenity and that would require the community to vote to amend the documents to remove it. However, in the long term this could work against you because most high end condos have a valet service, and people in the market for a high end condo are also looking for that kind of amenity. Your building may take a ding in value.

In my urban 'hood, there are many high end high rises that do not offer or require valet parking. Of those that do, one is the "premier" high rise and the other's kinda in the middle of the pack of, say, 20.

Residents' objection Is having to wait for the car when needed--sometimes, say 10 minutes.

I agree that it's probably in the governing docs as a requirement.

In an urban hood, the parking situation for residents and visitors may dictate the need for a parking valet.

And,, some luxury condos have valets that do other tasks such as collect trash and recycling, handle delivered packages and luggage, and perform other services that make the condo seem like a resort.

Our, I'd say, mid-luxury city center high rise, has Access Control Officers, "ACOs" who deliver packages to parcel rooms for owners to pick up along with monitoring and managing entry to our underground garages, which includes permitting authorized vehicles to park in Visitor Parking. We have 17 VP places, slightly more than most high rises around us. Our entire area of several square blocks has expensive street parking & one expensive lot.

"Picking up trash & recycling" is done by a staff of custodians, which is typical in high rises.

I imagine the 2 of about 20 that do have valet parking in our area assign other tasks to them as well--prrobalbu as doorman and luggage schleppers.

Is the special assessment that you received notice of to provide funding for the valet staffing? I would think that the valet staffing would already be in your operational budget. If the special assessment is not for funding the valet staff, what is it for and how does this connect back to the valet staffing debate?
