I live in an HOA in Florida . 55+ with over 500 homes. Are there any communities that have pool rules regarding number of guests a resident can bring and also are their special hours for kids to attend? Only one pool in community. Thanks

Your HOA, 55+ or not, may regulate the number of guests an owner may bring and the hours. Kids become a bit more problematic depending on your HOA rules.

Yes, your community may restrict the number of guests per owner at the pool. If you can restrict hours for children will vary on the residential status of the child. Even if that status is temporary. I would consult an attorney on that issue.

Anyhow, the pool is 20 X 60' and the original rule was ignored an then was deleted as there were no issues about "overcrowding."

Limiting hours that children can use the pool is an entirely different story since to do so can raise claims of discrimination based on family status. As Dean advises, your Board should seek an opinion from its HOA atty.

I'm curious about why there are so many children on site given you're an over 55 community. Lotsa grandkids visiting frequently????

If it does, then it can lawfully restrict the hours when children use the pool.

I will add, that if it does not, then you can not restrict the hours for children.

Yes your HOA can make rules about guests. You could say no guests (though this will be hard to enforce if guests are already permitted) or limit guests to 2 or 3 per household during peak swim times. I know grandparents probably want to bring grandkids sometimes and 2 guests may not be enough.

As for setting hours for kids, you could create "family swim" hours and lap swim hours. Regulating pool access based on age could be considered discriminatory, but creating lap swim time seems to work well.

Does the city you live in have any pool rules that need to be followed? Does your insurance company have any pool rules that need to be followed to protect your condo from lawsuits?

Yes we do have a lot of grandchildren visiting. Thank you all for your input. It has created some ideas. And we will check with the HOA Attorney
