Does your HOA have a towing policy?

Our roads are private and we prohibit overnight parking on the street. This mirrors the city's rule.

Do you tow violators? What type of notice do you give?

I do not have your setup.

My condo abuts to the municipal street. They do give out tickets. Your situation most likely will not have that. I had vehicles towed in the past. This is when a vehicle is blocking a driveway. They get the plate number and they must had access to the information because they are trying to call the person. I have seen that work once. Early morning pre rush hour they came and made a call and someone came running and moved the car. Other times no one answered and they towed the car.

I think in your situation you don't have the ticketing process and notification part either. So it looks like if the towing company is coming to tow is going to happen.

Is the issue a driveway block or general parking violation?

My last association had the authority to tow.
We never had to.

Those that parked in towable areas received a warning taped to the drivers side window (no way to claim they didn't see it).
The warning specified that future infractions were subject to towing.
We also wrote the tag number on the warning (gave the impression we were actually keeping track).

Never had to tow. Rarely had repeat offenders.

Proper notices must have been posted. That would be signs at minimum at the entrances advising vehicles will be towed between the hours of sunset and sunrise.

check with the city/county. My previous association simply had to fill out an agreement with the local police/sheriff dept. to have them enforce traffic/parking laws on our private roads. Tell them what you would like to address (parking on sidewalk) and see if they can assist.

Each State (perhaps county) requires specific signage for towing to be posted. Failure to do this can result in issues for the Association.
Check the local statutes.

Check to ensure your state/county permits towing first. There may be certain rules you need to follow. Towing should be used as a last resort, and there should be signage to indicate that cars parked overnight are subject to towing. I'd give a warning, then issue a fine, and finally towing for a third offence.

Just thinking out loud here.

Everyone has an escalation method in terms of towing.

My jurisdiction of the municipality has ticket, tow and boot situations. There is no warning. You got a ticket, a boot or your car was towed. They do access records to locate phone numbers but that does not always work. Also we have a high transit situation due to being in a city.

Will a couple of tows created an "enforcement" and then these situations drop in numbers?

Who do you think the violators are residents, guests or strangers who should not be there?

The fix to this is to hire a towing company to do the patrolling.

Expect push back from the membership.
