FL Statute states the association is responsible for replacing the drywall and the owner owns the covering. If the covering has asbestos in it who pays for the remediation?

What is this "covering" made of? Paint? Wallpaper? Paneling?

My guess is that since this "covering" was never defined as a "construction defect" within the statutes o limitation in your state or Govering documents, the owner is obligated to rapair/replace.

Covering is popcorn ceiling 5% asbestos. Hurricane damage requires replacement of the ceiling. Asbestos abatement is required. Association is responsible for drywall, mud and prep, owner responsible for covering.(paint, popcorn)

Our CC&Rs defines who's responsible for replacing such a covering. and it is owners. So please review the CC&Rs to see if they are different than the state statutes.

In addition, do you know who is responsible for removing this popcorn ceiling coverings?

Nobody does popcorn ceilings anymore, it is all spray-on knock down texture.
It is nearly the same product just a different consistency. The Knockdown spray-on
texture is applied right after the joint compound is applied.

The unit owner would just be responsible for the paint.

Have both the HOA and the member submit claims to the insurance and let the insurance companies figure it out.

Then go with there decision if the amount doesn't cover it all.

Either your HOAs insurance covers asbestos abatement after a major loss or it doesn’t.
