hi can someone help me out what is the difference between the two (hoa / poa?)

A tremendous amount of knowledge can be obtained by reading previously written posts concerning POA. The search provided in the top right of this page will scan all previously threads/posts written either by subject: POA (Property Owners Association).

I’m no expert by any means however. I do have some knowledge of its benefits here in Georgia. Not sure if residing in another state changes it structure or not. Perhaps someone a bit more knowledgeable, than I can provide you with further clarification pertaining to your state.

There are several advantages in being a POA. The fact that the governing documents will NEVER expire, is HUGE. IMO, were as some CC&R and by-laws will expire in 20 years or (if written in) will automatically renew.

Being a POA will also file an automatic lien, which is often over looked in association living.

Certainly consider opting from HOA to POA “If” beneficial to your association may be desirable in your association.

I've been told that POA's in VA are mandatory membership..not voluntary..maybe someone else can comment..also, to be mandatory it must be stated in your deed..and the POA must have a Declaration that defines exactly what the POA is.
We've been thru all this...and we are not a POA..it will take a 100%membership vote to become one.

I have had this conversation with a very accredited profession in the Management side of Home Owners Association. She say in this state (SC), the differences are very minor and very confusing to isolate. I know we have had some posters credit POA's over HOA's but she says don't matter when push comes to shove. The results are the same and so is the operation in matters of importance.
