In Florida:

Is the secretary required to put an item on the agenda that was submitted? Who can deny a board director from placing an item on the agenda?

I don't believe there is any requirement that an item must be put on the agenda just because it is submitted. If the board is split over whether something should be discussed, I think it would take a majority of the board to agree the item should be on the agenda.

In both the condo 718 and HOA 720 statutes, owners have the right to comment on every agenda item. In the condo statute, owners have the right to ask questions of the board at least four times per year.

Board directors are elected to handle the association business. If they don't feel something needs to be on the agenda, then that is their right and your only recourse is to elect a new board.

If a director asks for an item to go on the agenda, but a board majority refuses to do so, then for FS 720 HOAs, consider this option from FS 720.303 (2) (d):

"If 20 percent of the total voting interests petition the board to address an item of business, the board shall at its next regular board meeting or at a special meeting of the board, but not later than 60 days after the receipt of the petition, take the petitioned item up on an agenda."

FS 718 for condos says similar.

Edward, are you the secretary or someone who wants something on the agenda?

Interesting citation, Elle. My HOA recently had a situation where I believe that I, with a few others, actually could have collected 20% of (200+) owners to petition that a particular situation be placed on our open Board meeting agenda.

Btw, Boards can make a policy that individual Owners may submit agenda items. In my HOA, There is a form asking why the board should take up this matter? Is it something our governing documents & state statutes would permit?, etc. It must be submitted 10 days before the next regular ion meeting. If our CAM & presiddent believe it's inappropriate or impossible or etc., they must give those reasons to the submitter when they turn them down (which has never happened).
