Hello, I am part of a new board that each member is also new to being on a board. We have had several issues with unit owners allowing their dogs to mess on the lawn and not picking it up after their animal. We have sent out notices that indicate a fine will be put in place for owners not picking up after them. How can the board enforce this rule? How can the board monitor who's dog is leaving what mess or can all of the owners who have dogs be fined for the same mess? Its a touchy subject, does anyone have any advice?

We had the same issue in our subdivison. We sent out notices to all owners and indicated that once we received 3 written complaints, the fine would be automatic and if not paid within 30 days it would be an automatic lien on the property and would bear interest at the rate of 12%.

There have been numerous threads on this site with the same problems as yours. There is no solution unless you can catch the offenders red handed and you will need to document the offense with proof. What kind of proof? Photos would work well but who the heck is going to stand around with the camera and take pictures of doggies doing their jobs?

We have done everything that are within the limits of the State Statutes, including fining but those are few and far between. And you would be very suprised at the people who allow the mess to stay behind after their pet has done it's job. Solution, there really isn't any. You cannot fine all of the members just because they own a dog. That would call for a Hanging of the Board so fining all doggie owners certainly is not a smart decision to make.

I have never dumped toxic waste into a river, but I am paying for the clean up of the nation's waterways for others who did.

My wife has never used social security, and never will, but she has paid money for others who have.

I have never been to Yosemite, but i have paid to pick up the trash and litter left behind by the millions who did.

I didn't throw an eraser at my teacher in second grade, but I stayed after school and was punished for it along with everyone else in my class.

I never wasted $30,000,000 on a failed factory start up in my company, but I was forced to cut my budget by 20% to pay for that mistake.

I have never attempted the take over of an airliner, but I am searched and stripped of my water bottles by the TSA.

I see that most of life is an innocent person paying for the mistakes and lax attitudes of others. Why shouldn't it be done here?

What my HOA did was to put doggie bag dispensers out around the property at various strategic locations, along the main sidewalks and near the greenbelts. We also put out two large trash cans near the greenbelts.

The dog owners seemed to take to it very well and police their own. No one wants to walk through a greenbelt full of dog droppings, so they will speak up if they see someone not picking up after their dog.

By making it convenient and easy for the dog owners, we have pretty much elimated any problems with the dog droppings.

Brian - your analogies are great - except they are not imposed on you (us) as a fine - or at least called a fine. Nor are you singled out for this charge because you own a (fill in the blank) i.e. dog, etc. If I lived there and chose not to pay this dog doo fine, I'd be termed "not in good standing," with all the ramifications.
If, like the examples you cite, it is determined that an action needs to be taken, there should be a line item budget for animal waste cleanup, where indeed all members, even non dog owners, would contribute. Maybe that would make the homeowners angry enough to begin a stakeout to confront the violators who are costing them money. But to fine all dog owners unilaterally is ludicrous - and the mess would still be there.
Actually this sort of idea, if implemented, would delight the media. As if we need to give them more fodder.
