My CC&R’s give authority for right of entry to remedy a violation if court ordered. Heres where it gets crazy.. there was a court order that stated “has the right to enter to remedy any violation to bring property in to compliance with covenants.” Our covenants do not state anything about the backyard, anything it says about covenant violations at all state from “street view”. I have video of our HOA coming to my backyard, getting out of their vehicle, walking up to my privacy fence, and taking photos of my backyard over my fence. I leave and go out of town 3 hours away after this court order is obtained, I made sure my yard was in compliance prior, while I’m away the HOA hired a vendor to
Come into my backyard and literally remove every single thing I own. EVEN MY GARBAGE CANS. My lawn mower, my child’s bicycle and scooter, literally everything. My shovel and rake, my patio furniture, everything. Is this legal??? How can they do this??

What did the Court Order say?

Stated that the HOA had authority to enter the property to bring the property into compliance and remove any violations. But they took everything I own that was in my front and back yard.

Going today! Even with an order to bring property into compliance IF NEEDED, that should not allow them to take everything correct? I mean EVERYTHING. Kids toys, trash cans, garden tools, pots and plants out of my flower beds, I had some shoes and a coat on my
Back patio, they took it, a light up cross in my flower bed, been there for 2 years now, wind chime, lawn mower… I’m just shocked

Are you saying the LEGAL letter you received DIDN'T STATE the actual violations you were "violating?"

I am shocked you failed to cooperate with your HOA and they had to go to court, show cause, get a court order and hire a vendor to remove your stuff. Without knowing the specific violations, no one can determine if the actions were reasonable. Usually HOAs are permitted to adopt regulations in addition to what is specific in the covenants.

It is highly likely you will be billed for legal fees and the cost of vendor in addition to any fines the HOA may have levied.

File a police report for theft of property.

Hopefully the police will investigate and properly file an information report stating this is a civil matter between the homeowner and the HOA.

I am just going from memory and not googling on the topic. My recollection is you are correct.

However can you afford to do more than threaten the HOA?

You can certainly write the HOA and tell them to return your belongings immediately or you will be lawyering up. But truth to power: The board will likely be overjoyed to read that you are paying a lot of money to an attorney and you will not get it back.

You really need an attorney. This will cost a lot of money.
