The Colorado Common Interest Ownership Act (CCIOA) requires associations to make annual disclosures within 90 days after the end of each fiscal year of certain documents which are described in the act.

The ssociations are required to make the informatio available at no cost to unit owners and it can be done by one of the following means:

1.Posting on an internet web page with accompanying notice of the web address sent via first-class mail or email to all owners;
2.The maintenance of a literature table or binder at the association's principal place of business; or
3.Mail or personal delivery to all owners.

Our Colorado HOA has 221 member, some live full time in area, some in other parts of Colorado and states (vacation here)

We have a web site and board has chosen to use it exclusively for disclosure. Some members do not have computer access/e-mail/high speed access. Web site requires high speed access to download documents in PDF in a reasonable time.

Ther is no principal place of business (except a PO box).

QUESTION
Does board meet legal requirment for disclosure even if some members are denied disclosure , i.e no computer access?

Duke, you are not denying disclosure. It is on a website plus a binder can be maintained by your Registered Agent for owners access.

Also consider that many libraries offer free Internet access so really, everyone does have access.
