Someone as question at board meeting (community member)the question was omitted from the meeting minutes.When a board member questioned why the remaining board voted to keep the question omitted.Is this allowable?Board sends out ballots to community and community mails back ballots.Community member as for recount 2 months later.Does the votes have to be in original envelopes or can they just be stacked in a pile out of envelopes?Thanks!

An agenda contains what the board is going to consider at the board meeting. Board minutes are a record of board actions, not a record of what any statements or questions. As an example, your agenda might include “Owner questions and Comments” and minutes might say “The board received comments and questions from homeowners in attendance at the meeting”.

An owner can request anything, that’s doesn’t mean the board has to respond to the request. If any member believed there was an issue with the election or the ballots, that objection should have been made at the open meeting when the election occurred.

Thanks for clarifying about the minutes.There was no open board meeting with the voting.They sent ballots out in Oct and they was due back in mail in December.They sent emails with results.There was an open board meeting at the end of December where they read the results.I think it was after the meeting people put things together and realized something wasn’t right.Do they need to be in envelopes?Thanks

It's better to open the envelopes at the meeting and counted at that time. You don't say Mr. P voted yea or nay - simply indicate if the vote was yea or nay.

What was the community voting for? It's one thing if this was for a CCR amendment, where you do need to ensure that (1) owners casting votes are listed on the ownership list and (2) you received the required number needed for the amendment to pass, e.g. 51% of 100 or 51 votes.

Check your documents to see if you can request to inspect the counted ballots and then you can do your own math to see if there were enough votes cast to approve or shut down whatever you were voted for. Note this doesn't include you knowing how people voted.

Should the ballots been in envelopes? That depends.

Hopefully your HOA does not vote by secret ballot and every ballot has a signature. In this case, who cares if the ballots are in envelopes.

Mail in secret elections need 2 envelopes, the outside envelope is discarded and the inner envelopes remain sealed until counted.
