We are dealing with an owner testing the removal of restrictions of mobile homes parking in owner's driveway. We are a small HOA, 10 homes. We had in our by-laws restrictions on boats and mobile homes in owners driveways. Recently an owner bought a new mobile home and is parking it in their driveway. They state as of 7/25 HOA's no longer have the right to have this restriction in HOA"s in the state of Florida. The HOA president is checking with our attorney. Are there any other HOA's facing this new issue?

-- I do not see that the legislature or statute defines "personal vehicle."

-- Does this mobile home have its own engine, like an RV? Or is it just a home on wheels, that can be towed?

-- In my opinion if this mobile home does not have its own engine, then it is not a "vehicle." Big caveat: The mobile home may very well be titled as a vehicle. When my argument is weak.

-- If the mobile home has its own engine, IMO the owner is within his/her rights.

-- My remarks are preparation for discussions with the HOA attorney.

Typo. Change "When" to "Whence".

My take is a "motor home" is a "personal vehicle." Hence the new law declares void those covenants that restrict parking such personal vehicles in an owner's driveway.
