Hi guys,
Need your help again,
Ever had a property management company leave to off site premises/office,bring in another hoa manager,and claim you will have a strong presence in the association,after learning of a active investigation,and the homeowners that were delinquent, balances begin to drop,yes,drop.
I recently discovered a member of 3 units,a vendor, being lawn care and maint,also engineer, that deemed buildings unsafe,or owners may have to leave if special assessment didn't pass,and would get the judge to order owners to pay the assessment, the last one being in july,2024,for over $4k plus to each homeowner,and withholding who the engineer was until recently,in the last 2 years minutes of the Board shows,and this one person holds no engineer license in his name,in south carolina.
This same guy,started advertising he was a owner/agent at Nationwide Insurance, with his address and phone number,which is his home address in the hoa.

I recently discovered he is using 2 different social security numbers, using false names,has a criminal background history of assault and high and aggravated assault with a deadly weapon, possession of heroin,child neglect,and much more.
Also driving around on a state issued(supposedly) beginners permit,due to many traffic violations.
Do you think the board of directors knew,or should have known, by doing background checks,etc.and/or would you hire a person with this background,and should knnow,you can't be no Insurance man with that kind of background,and red flags come out to the social security numbers being used in order to hold all these different licenses he claims to hold..
Please remember, this info is public knowledge, and is where the info came from.
I will say,I'm very nervous about harm coming to someone,as things have escalated, and is getting out of control for the board and the owners,and I do not know how this is going to end,and should have been avoided from the get go in my opinion,what's yours?

I am not very good at reading. Your post was difficult for me to follow. If others can read it then you are good since you will get advice. If they can't you might need to reword so we can assist.

It really doesn't matter what our opinions are about what was found out (unless your simply looking for someone to agree with you).

Most people take other people at face value unless they have been a victim of issues in the past.

Some boards who utilize a property manager will often defer to the property manager because they are the "professional" and should know what they are doing.

You don't say when you started your investigation into the situation.
I expect it wasn't prior to hiring but after seeing something or hearing something.
Your board may have done the same.

As I said earlier, it doesn't really matter what our opinions are.
What do you see as your options now that you know these things?

These are the facts I believe exist based on your post.

Your HOA has 2 financial issues:
A delinquency problem with too many owners not paying.
Your HOA has a problem because the owners will not authorize assessment increases to pay for required repairs.

You have an investor who owns 3 units desiring to protect his investment. He is making threatening court action to require the assessment passage if the owners don’t approve it due to structural issues.

You have a property management company that has replaced staff and moved the physical office off premises and states they will maintain quality service.
The property management company with the new manager is cleaning up delinquencies.

All the stuff about 2 social security numbers, traffic violations, doing background checks on an owner, what businesses he operates, what licensing he qualifies for, ect is not relevant. The financial solvency of your HOA is the primary issue.

Your post is difficult to follow, but is the association at risk in any way because of this person? Is the special assessment necessary to maintain the safety of the property?

The HOA may want to start asking for references for service providers moving forward, but if this person has lied, then there is no need to worry about him taking an issue to court. If he is telling the truth, then the association needs to fix the issue.

I thought the management company was to run the day to day operations of the hoa.
I do not think a law suit is apart of the day to day operations,that is the boards responsibility.

Have you brought your findings to your state contractors licensing board or perhaps the DMV
enforcement division?
