Hello - I was curious if there are any advocates located in Idaho that may help members who have concerns with how the current board of directors are managing their HOA? Concerns include financial, maintenance of common areas and directors not abiding by the bylaws.

Google is your friend- you could contact the Idaho Attorney General's office to file a complaint, but if you're unhappy with your board, why not check your documents to see what's required for calling a special homeowners meeting? These are usually where homeowners can express their concerns and demand answers from t g e board -or conduct a recall vote.

If the recall succeeds, you'll need a new board, which means several people will need to step up and run for a spot (assuming you want to get rid of everyone). You may need to step up for a spot, and so you'll need to get well acquainted with your documents to see how the association is supposed to work, compare 5gwt to what's been going on and then prioritize what you need to address immediately and go from there.

As you might guess, this isn't easy and won't happen overnight, and although you can contact the AG (go to its consumer protection division), they don't work overnight either, and don't represent individual homeowners in private legal disputes, so you might have to file a lawsuit. That means more time and expense in legal bills, going to court and then getting the judgement processed if you win.

None of this is to discourage you, but you need to be aware of the pros and cons of whatever step you take and decide how far you want to go. That's why it's usually best to get together with like minded homeowners to put the board on notice that they're being watched and you will be checking that they're running the association according to its bylaws and CCRs. If not, some or all may risk being voted out in the next election.

There are lots of old conversations on this website about tossing out bad boards - actually, i think there are at least two recent ones that may still be active. Read a few and bring your questions here so you can get updated information. Good luck in whatever you decide to do.

Is the Association still being developed or has the development been turned over to the homeowners?

If you can provide a specific instance of not following the bylaws, you would get more detailed answers. Just don't mention your Association name or the name of any individual (to stay compliant with the forums posting rules)

Most Associations are incorporated and fall under the States nonprofit corporation act. If this is true for your Association, here is a link to IDAHO NONPROFIT CORPORATION ACT

In addition to your States corporate law, the Association also needs to comply with the Idaho HOMEOWNER’S ASSOCIATION ACT
