Hello: I am new to the game so please forgive the laundry list of requested help. Recently I was elected as President for our HOA; along with four other board members we are all new to running an HOA. Does anyone have a copy they can post or refer me where I can obtain info on laws pertaining to HOA’s in Florida?

Our community is gated; we have problems with teenagers and adults trespassing in our community, jumping fences between subdivisions and running through yards, using our clubhouse, gym, pool and basketball court and claiming to be visiting a resident.

The Board of Directors and I just took office but we are considering having the local police come in for a few hours a week and possibly hiring a contract guard as well. We will soon complete a security upgrade that includes CCTV and a DVR system. Any guidance on anything else we can do?

We would also like to modify our property rules and regulations that govern our recreational facilities, pool, tennis and basketball courts, our gym and clubhouse. Any suggestions?

I would be interested to see other single family home community covenants and some property rules and regulations if they can be posted or sent to me via email.

You need to copy the 2007 Florida Statutes 720, because that is your operating requirements. If you do not have one, go to "GOOGLE" and type in

" Fl. Statutes 720." It is the first item on the list.Print it out because you MUST not avoid using them.

Your own HOA documents, including Covenants, Articles of Inc, ByLaws and rules and regs should be available to every resident. The Developer would have presented them to the original buyers. Unless they have been amended, that is what you must follow.

It doesn't sound like you need to implement more rules. If people are trespassing, a rule won't stop them. Sounds like you have an enforcement issue. If you hire guards, what will they do?

I would start with what you have and create a plan to deal with existing issues. Leter, perhaps more 'rules' may be needed.

What are the residents concerned with? Deal with that!

Just as has been said, read your recorded CCRs over and over. Read 720 over and over, and remember that your recorded CCRs "run with the land". Your Rules and Regs can only clarify what your recorded CCRs state, and carry less weight. So be wise not to try to create rules and regs that are more restrictive than your CCRs, with regards to an owner's rights, because those rules and regs will not be enforceable.
