I am on the board of a 500 member HOA in Washington State. Just north of us they are going to be developing 34 new homes. We have been approached about an easement to tie into our water and sewer lines, and for them to install water drainage lines. The water and sewer would be under common property which already has power line easement. The drainage overflow pipe through common property then down into a ravine.

The person that we have been working with has represented himself as a “friend” of the property owner, and has no interest in the property. They are offering us 24,000.00 plus our attorney fees and a reserve account to run independent studies on any drainage issues we may have.

We have had meeting with the homeowners, our attorney, and the interested party. They would like us to sign a Letter of Intent stating that we will work with them until everything has been approved by all the engineers and city, once approved we will sign the easement.

Well we just found out the “friend” of the owners is actually in the business of setting up developments than selling them to a developer. He also has a contract with the elderly owner in the amount 525,000.00 plus.

The board was already to go ahead with everything … until this information turned up. We feel somewhat betrayed and lied to and don’t know if we should trust this person. We also don’t know if what we are being offered is a reasonable fee.

Has anyone gone through granting an easement of this nature or have any advice.

Go to your city or county planning offices and find out what is going on out there. Until you understand what these offices understand, I would not suggest signing anything. Seems to me your attorney would tell you to do this. It is obvious this friend knows how to play the system and is trying to build as good case to present for developement. Be careful.
