I obtained a roofing exception (type of shingle required was "scallop" but used regula) in 2015. Now I have hail damage and the roof needs to be replaced. My insurance company will only pay for replacement of the current shingle. The HOA will not approve, insisting the "scallop" shingle must be installed. The difference is $11K. My question is whether there is an expiration to the exception that was granted in 2015.

Personally, I would think not.

Expecting you have a copy of the written exception, so you have proof, and that their is no requirement in that written exception for you to change back - you are not changing what was. You are simply repairing/maintaining what was approved.

It would be the same as if you replaced the roof due to age vs. storm damage.

That said, if your board thinks otherwise - you may need to check with a local attorney on legal options.
