How do you take nomination from the floor when you have already turned in your ballots at the door? We only have one vote per unit.

DianeE2 - You don't take ballots that are cast at the meeting in person prior to nominations from the floor. After nominations from the floor, then and only then do you know who all the candidates are. Proxy ballots may be handed in, in advance of a nomination from the floor. Curious what others have to say on your post.

We have a ballot box as you enter and you MAY put your ballot in if you wish,at that time.

The President at the start of the meeting, after roll and all of the preliminary stuff, asks if there are any nominations from the floor?If there are, then he instructs the ballots to be cast. He then states that all balloting ceases at -- (Blank Time)
Then the election or counting group, retreats to a corner or other room, with spotters or monitors, whatever you call them. Then let the fun begin.

Statutes (Fl) do not have any wording as to restrictions on the proceedure other than "if the governing documents so provide", which means, unless you have a different proceedure, then you follow basically what I have just written.

Thank you Donna. What they wanted to do was take the ballots as you walked in. I told them they can not do this because of the nominations from the floor. They told me I was wrong.

DianeE2 - If they offer each person in attendance an opportunity to hand in the ballots, and it's clearly told to each person that nominations from the floor can occur, than shame on those that turn the ballots in. The Board should not force the ballots to be handed in, that is wrong.

Arizona does not allow floor nominations because it would disenfrachise those who voted by mail. Arizona also does not allow proxies. A good idea.

Well Harold what they did last year was after everyone gave the ballots at the front door, then they didn't expect nominations from the floor. They just went ahead and let the people vote! YEP THAT WAS TWICE!

DianeE2: You need to review your documents (CC&R and state documents) which would address whether nominations from the floor are allowed. IF the Board has in previous years not expected nominations from the floor, then it may be that your State/Assn. does not allow them.

To take another position in this situation, it may be that the Board only desires nominations which have been "cleared" (members in good standing) and do not want to accept nominations from the floor as a last ditch effort to get someone else on the ballot.... At least two ways of looking at it.

I fail to see why nominations from the floor, or directed proxies are frowned upon. I'm sure someone will enlighten me of their horror story. However I doubt there wasn't a wording solution that could have prevented the problem. We use directed proxies and nominations from the floor in our HOA/COA, and have never had an issue. Proxies count towards and therefore increase the chances of quorum. Many people can't attend a particular meeting the night of election. If owners know that someone could be nominated from the floor and choose to cast their proxy ballot for an announced and listed candidate in advance, doesn't that decrease the chance of someone who is nominated from the floor from being elected? Seems to me it does.

We are in Florida and yes they do have to. The 720 Florida Statue even states it. They may not want to but they don't have a choice. Have they in the past, I'm sure they have not. They have never done anything according to the book or law. What ever they wanted to do is what they did.

Harold, first off I want to thank you for posting here. I always read your posts because of your knowledge of Arizona statuates. I see where proxies are not allowed for voting in AZ 33-1812, but I do not know where Arizona prohibites floor nominations. Can you enlighten me please?
