We have a retention pond in the back of our home. Periodically someone in the neighborhood decides to put in their radio-operated electric toy boat into the pond. It zips back and forth and makes a horrible buzzing sound. Is this against the statutes for use of these ponds? If so, would the county be responsible for responding to a nuisance call?

FWIW, all of the ponds in HOAs usually have signage prohibiting things like swimming and other recreational uses. This is mostly for liability reasons, since ponds are attractive nuisances and are accidents waiting to happen.

So even if your state saying nothing about this, the HOA should know because lawsuits are expensive.

This sounds more like a noise complaint than use. You can call the police. However, can also report it to the HOA board to ask about what can be done. Do not be shocked if they come back with "Call the police" as the answer. It is considered "common area". Do not know what actual actions they can take outside of putting it on the fining schedule as an offense. You can simply request that to stop doing it because it is loud and annoying.

Statutes do not cover this. But covenants almost always have a "nuisance" clause. If your covenants do have a nuisance clause, then you could submit a complaint to the HOA, expressly naming he covenant you feel the noise is violating, and ask the HOA to enforce the covenant against nuisances. You could also take action against the neighbor yourself.

Providing video (with audio) to the HOA would be best. You also want to document how often the noise happens. If the noise does not happen frequently, then you are probably out of luck.

I'm with Dean. Who owns the pond? Is it owned by your HOA, another HOA, the city or the county?

Once you figure out who owns the pond, you can figure out who to complain to. If it's the HOA, call and speak to the property manager or a board member. There may already be rules that don't allow this on the pond. If not, they might make a call for you and ask the person to stop, or they may pass a resolution to add that rule to the existing ones.
