we are in the process of attempting to revitalize our CCR's. in the process it was discovered that we are indeed 2 incorporated HOAs/Communities that has been acting as one. We are considering formally merging the 2 communities and their letters of incorporation, once incorporated holding a meeting elect a Board and reapprove our CCR's. if we do , we would have a new incorporated HOA,new CCR's WOULD WE ESCAPE THE NEED TO REVITALIZE OUR NEWLY APPROVED ccr'S.

I would think that you would need to revitalize the existing CC&Rs prior to amending the old covenants.

If you simply create a new set of covenants, you would need 100% agreement from everyone in both communities OR those that don't sign, would not be accountable to the new CC&Rs.
