hello all,

i have owned my property for for 26 yrs. i never signed or agreed to be a member of any association or propretorship which was formed 15 yrs after i have owned my property. my deed was changed by this proprietorship with out my approval or knowledge, what are my rights??? i do not want to be a member of any proprietorship nor do i want anyone having authority over my property but myself, what can i do to stop this. i was served a warrant today to collect their proprietorship fees. i was also informed that i cannot sell my home without their prior approval. i feel this is against my rights as an american citizen. what can i do??? do i need to get an attorney to deal with this or can i do this on my own.

My best advice to you is to seek legal counsul as we are Board and association members, working to solve association problems. Thank you, Donna

AlJ - I'm stunned anyone could change your deed or obligate you to be a part of a proprietorship without your approval. I'm also stunned that it's taken 11 years for the proprietorship to catch up with you. How many years in back fees are they seeking? And yes to Donna's post, get an attorney.

Absolutely. Sue their **** off for tampering with your deed without your approval. That could be criminal too. I thought it required 100% approval to start a new association. Unbelievable. Are there others as surprised as you? Gather together. Good luck. Harold

Wow, that's really an interesting tactic! Yup, if I were in your shoes and nothing in my property docs said one COULD be formed and your property subjected to it, I'd get an attorney.

Please, please find an attorney who specializes in HOA law. It does take a 100 percent vote...we are dealing with the same sort of situation here in VA...have a great firm representing several property owners...it's very expensive..but our deeds have been violated by a fraudulant document...and we can't allow that to stand. I wish you good luck..please keep us posted..
