Can the POA report residents who don't pay their dues to the credit bureau? Also can the POA report residents who don't pay their fines to the credit bureau?

This is a Texas POA.

Considering POA or HOA's are NOT allowed to have one's social security number, it makes it harder to report to the credit bureaus. Plus that is why one uses Liens or foreclosures to force paying dues when not paid.

It should also be noted that in many POA's or HOA's, an undeveloped lot does not pay dues until it is developed. You may want to find out if the lot has to be developed before it has to pay dues on it. It's not necessarily a situation where one size fits all for the answer. Just suing for the dues is NOT the way to go. Bad idea.

I agree that there is no requirement to provide SSNs to an association, please tell where it is documented that HOAs/POAs are not "allowed" to have them.

You do not need a SSN to report to the CBR. If you hire a collection agency to collect late assessments, they will report it to the Bureau.

Does your HOA have an established schedule procedure for collecting late assessments?

I say a POA or any other type of a homeowners association cannot report directly to a credit bureau. That said, if the associations hires a debt collection attorney it can be reported to a credit bureau but only unpaid dues not fines.

Per the following article, an HOA/COA/POA may report delinquencies to the credit bureau.

HOWEVER, there are some rules that must be followed or the Association can find themselves in trouble.

see: Property Owners' Associations from the TX law library (scroll down to credit reports).

I will add what a business owner told me in my last Association:

They added "failure to pay may be reported to credit bureaus" to their billing.
They had zero plans to actually report anything to credit bureaus.
Adding that sentence to the bottom of their invoices had a 50% decrease in their delinquent account.

You may simply want to add a similar statement to your late notices.

As LetA pointed out, an SSN is not required and does not make it harder.
It will improve the accuracy of the credit bureau listing the issue with the intended person.

It has to be reported. Just reporting may knock ones credit level down some points.

I agree with Douglass.

Anyone may ask for your social security number and are allowed to use in accordance with applicable laws. However, you are allowed to refuse to give your SSN number to them. This may or may not result in the requester refusing to provide services.
