My home is a condo is in a building with two units. The unit attached to me has some pretty major foundation damage to walls and ceiling, my unit has some minor issues. The HOA is currently having the building inspected to determine the extent of foundation damages and associated repair costs. They are currently looking at a company that does the repair from the floor as opposed to tunneling under. This will cause myself and my neighbor to have issues with our interior flooring, at his point I don't know the extent. Is it HOA responsibility to cover these costs or will that fall to us the condo owners?

Wait until after the inspection to see what's at stake. In the meantime, check your documents to see what the association is responsible for vs. homeowners.

You may also need to check your insurance policy and discuss the findings with your agent. I live in a townhouse community and the homeowner is responsible for everything from the drywall in. It may or may not be the case for you.

With Shelia: It depends on thee insurance required by your CC&Rs. My condo HOA has insurance like Shelia's, so the HOA would repair/replace/level the subfloor, but I don't know about the floor covering.

Not necessarily. In my community, it would depend on whether the damage was the result of something like an earthquake (an insurable event) or as a result of routine wear and tear (a maintenance issue). If the first case, some interior repairs would be covered by the master policy because we have all-included insurance. If the damage resulted from routine wear, then the condo owner would be responsible for all interior repairs.

Boards sometimes assume that damage resulting from something going on in the common elements (eg. a leaky roof) becomes the association's responsibility. Or they want to be "fair" to an owner who is upset about a big repair bill. Not so - it's strictly who pays for what according to the CC&Rs or the master policy. Condo CC&Rs usually spell out these responsibilities in detail, so that's the first place to look.

So true--condo owner especially think "damage from common area"; HOA's responsibility. Some new board members in my HOA often are shocked to learn it just isn't so with our we walls in master policy.

We have in our CCR's that the owner is responsible for anything inside the studs. The HOA covers the cost of the foundation repair but it is on the homeowners to replace/fix anything inside their home after the work is completed.
