Old management company sent an out of state HOA voting documents to everyone in the HoA they don’t manage

So I’m the current president and it appears that we have two scenarios:
1. our ex-management company sent the voting documents for a board in Florida to every homeowner in our Colorado HOA
2. Our current management company sells our data and somehow the lists got mixed up

I believe it is the first option….os there any issue with PII in this case?

I would say read both contracts. Did the old. Contract terminate correctly? I would contact them and tell them what happened. Plus you are no longer a customer.

As for selling your information that is in the contract if they do. Have no idea why they would. Little odd. Read the terms to find out.

As for PII... No social security numbers or health information shared. Every one should have what anyone can Google. Which is name and address. As far as phone numbers many no longer have landlines or in a phone directory.

Note a HOA should never have social security numbers not in some states email addresses made available. It is controversial but email addresses in some states are not public information to be shared without consent.

I experienced this just once. The office staffer stuffed the envelopes for another community in
the envelopes addressed to my community and vice versa. The PMC apologized and they ate the
cost of the postage. I'm sure it was a clerical error because someone did not take your community
off their active list.
