Hello , When I came on here tonight there was a discussion about banning bicycles, etc on sidewalks. some people were saying the seniors were complaining. Four years ago I was 67 , I don't consider that being a senior. A person was on a hoverboard on the sidewalk and pushed me off the sidewalk. I got an injury to my knee which is for a lifetime. My point is that yes if your condominium association has a rule against using any of those, bike, skates, skateboard, hoverboard anything that is propelled by a human should be banned from sidewalks. As for the law, local law is over state law and condominium rules are the ones that are recognized above all. Some people who are on one of those items do not yield to pedestrians no matter what age they may be..

Must be tough living in a state that only has roads with 55 mph speed limits to ride a bike on. 39 other states and many cities in NC prohibit riding bikes on sidewalks.

I think you have things turned wrong. The HOA rules have to be in compliance with Local, state, and federal laws. They can be more restrictive BUT the other 3 supercede the HOA's rules.

Our state you are not allowed to ride bikes etc... on sidewalks. People do it because it's more safe than driving on some roads. We are getting more an more roads with dedicated bike lanes. However, I don't think a HOA will install them.

Your choice is to report the issue to the police. They have the right to enforce the rules. It isn't the HOA responsibility if someone gets hurt if someone is doing something against the rules/laws. If injured, that person whom injured you can be made responsible via a lawsuit. It will be a factor in the lawsuit if it was on a sidewalk illegally.

I'm sorry for your injury.

I have an issue banning something for all when one or two individuals were being inconsiderate of others.

My last Association used advertising safety to try an minimize the issue. We even provided address of skate parks in the area vs. using the roads and sidewalks.

In my current development, we don't have sidewalks.
Everyone has to share the roads.

Usually, a path has to be 6' wide to safely accommodate pedestrians and bicycles.

Hello, The rules in this condominium community are the first to be enforced. The rules were made for safety and liability, next in line is the local ordinances and then the state laws. Condominium communities are different, and we do not have an HOA. Our State Laws leave it up to Local Laws or ordinances who then leave it up to the condominium communities. The police here do not enforce our rules, we do.
