My community is facing this problem right now. Any ideas?

Management company AUTHORIZED, DIRECTED, KNEW and HAD A WORK ORDER ABOUT MAINTENANCE PERSONNEL ENTERING AND REMOVING CEILING MATTER IN NON COMPLIANCE WITH STATE APPROVED PROCEDURES FOR REMOVAL OF Asbestos ACCORDING TO CPSC Document #453.

MAINTENANCE PERSONNEL REMOVED AND DRAGGED THIS CEILING ASBESTOS MATERIAL OUT THE FRONT DOOR OF THIS UNIT into the common area AND ILLEGALLY DUMPED IT INTO THE TRASH BIN.

THE Management Company DIRECTED PERSONNEL which DID NOT HAVE professional TRAINING in methods for safely handling asbestos NOR OBTAINED A PERMIT FOR SUCH REMOVAL AND PUT THIS BUILDING AND ITS RESIDENTS IN A HEALTH SAFETY RISK AND POSSIBLE EXPOSURE TO asbestos.

There is no question here on what to do. Contact the EPA as this is under their jurisdiction. BUT, isn't it kind of late as the work is done now? Shame on the Board. I think that they could be fined. This is something beyond looking for our advise as this is a Federal issue.

I actually have a lot of experience as a developer in dealing with asbestos and these situations. First - contact your environmental municipality and WORK WITH THEM and give them FULL INFORMATION. The more cooperative you are, they better and easier they are going to be to work with you to correct. Advice your management company to get the owners involved. Have you checked with your HOA insurance and are you already noted as additional insured on your management's cert of insurance? Are your maintenance crews employed by the HOA or employed by the management company? Let the experts tell you WHAT to do and then do it! May also want to chat with a remediation expert in your area for advice as well.

Robert - you can also search back in the Denver Post articles from within the past 5 years about an asbestos issue at Fort Morgan High School. There are people who went to jail in those instances - be totally upfront but contact environmental municipalities immediately.
