Can the HOA Board ask for a copy of an inspection report as people sell their condo units? Two owners are selling their units and I have to fill out the resale certificates, etc. (I'm president) and usually end up taking calls from their realtors. One of the realtors told me that she had almost sold one of the units a couple of years ago but it looked like it had faulty wiring and that it looked like someone had wired it themselves. So the buyer backed off. I thought getting a copy of the inspection report would help the Board know of potential problems; however, I don't know if this is legal or not to ask for a copy. Most of us here would gladly hand a copy over, but if someone has done some remodeling that may be "iffy", they may not want to. Thank you!

What is the Resale Certificate? Is this a state law OR is this something your community and Board have decided to do?

If this message shows up twice, I apologize. I was in the middle of something and I'm not sure I hit submit. I was hoping that having a copy of the Inspection Reports as people move out would show us any potential problems with that particular unit. We have people trying to be "professional handymen" and this could pose structural problems. Yes, we have rules about remodeling (for example - taking out a support wall), but that doesn't mean someone won't do it. Someone's deck had a spot near the wall of the building that was rotting and we didn't know it until the place went up for sale. This could have caused a problem with the structure of the building. I'm pretty new at being a Board Member and just want to learn more. I don't mean to insult anyone or ask for something that I shouldn't have. I thought seeing the Inspection Report of people moving out might be a good resource, but if you think this is a horrible idea and an invasion of privacy, I won't ask for it. I appreciate your knowledge. We're only 10 units and will never have a management service (too costly), so we have to learn how to be a good Board Member, mostly by experience. Yes, I've read our CC&Rs until I practically have them memorized, but things like this come up that aren't in there and I need advice. On your other question, a Resale Certificate is filled out by the President of the Association for the realtors/mortgage companies. We provide a lot of information to the mortgage company like financials, minutes, rules, dues, etc.

Paul - sorry, I don't think I completely answered one of your questions. The president is required to fill out the Resale Certificates because the Board has all the information for it. I don't know if it's a state law, but probably is if you don't have a Property Management. The Board is held responsible for this information. Believe me, if I didn't have to fill it out, I wouldn't. It's very time-consuming.

Just a thought, if you request copies of the inspection reports (and there will also be some buyers who don't obtain one - no idea why), I would be concerned about the risk and appearance of the HOA becoming a party to the contract. Unfortunately I don't have a lot of experience with condos so my knowledge may not apply to your circumstances, but in a home inspection I would stay away from them.
