Hi everyone,

My Florida home is in the middle of a deed restricted community.
I found out it is surrounded entirely by city property as utility easements and city streets that the HOA sold to the City some years age.
As such it appears to have effectivly become an island of a few homes currounded by city property.

How might it affect my deed-restrictions, if at all?

My square city-block multi-story condo building also is completely surrounded by city sldewalks and streets. The extent to which our HOA "encroaches" on city property--as allowed by the City --is spelled out in our deed restrictions (CC&RS).

I'd think yours would be too, Frank.

Your deed restrictions would not be affected.
They would still apply.

There is an abundance of HOA communities that have public roads that abound them, it is not uncommon.
A good indication of this is very low assessments.

In my tract, this is not common ground. Only two lots are affected but 50% of our lawn maintenance is spent mowing city/county right of ways grass.
Let us say $1500. Some board trustees seem to think it looks good and I'm getting told not to tell the rest of owners. They call it mumbo jumbo. I'm getting tired of this, 30 days on board and losing it.
I have 40 years as a Real Estate Broker with degrees in Finance and RE. CAR arbitration judge, and served 12 years as an SP panelist.

what is the proper way to handle this situation? Just ignore or disclose

Are these expenses on your monthly financials, tom? And if so, can't any owners request them to review? In my HOA, the city demanded the sidewalks around the sq. block be colored in beard blank and grey stripes form the developer, which is a theme is a few contagious city blocks. So not only does the HOA pay formally policing of he sidewalk, cleanup, debris out of tree wells, mopping spills, etc., the city only will pay half to resurface these sidewalks (est. at $30K).

If any owner asked. they'd be informed that the expenses to do the janitorial work on them is built into the janitorial contract. Imo, as a long time board member, it's about 1% of the contract. I don't think any owner would be upset, so why does your board want to keep this "a secret?"

But, you might try to give your Board more time if you want to truly help serve your community.

Im the newest guy on the board. the other say they are too busy to help much. I took it on as no one else would..or except to just say they are on the board. even that... 12 units.... limited pool. I have served in Ca. on HOA boards so not new... I was a city commissioner and felt it would not be right to be on the board with conflicting priorities. the problem is they don't want to "rock the boat"
I want to be totally open, transparent and keep the neighborhood values up.
