Technically, you are only supposed to discuss what is specifically called out on the agenda. If you were to put the item on the agenda under "old business", then you could speak about it. So no, if your board was following the statute to the letter, you could not have a discussion on something not on the agenda.
Our board does follow the agenda and allow brief discussion from the audience on each agenda item, which is required by FS 720. We also allow open discussion at the end of the meeting. We don't have to do this under the statute. We could not vote on any item discussed in that section of the meeting.
My question is why you don't just ask your board or your PM for clarification? Why do you need to wait until a board meeting to bring it up?
