Hey,Thank you all for the wonderful advice and great info on all my questions..When i read a Statute i dont understand i go to the pro's (YOU GUYS)So....what is the difference in a meeting that owners have to be informed 14 days in advance versus a meeting that has to be posted 48hrs in advance..Thank you Kevin

KevinJ1: Read, read, read your docs. We cannot tell you what your docs state and the difference in time posting requirements.

Your docs will state the difference you are seeking and how a regular Board meeting, an open resident meeting, vs. a special meeting called by residents for a special purpose varies in the requirements for posting. Your docs are your bible for community living. Know them inside and out.

Regular or monthly Board meetings must be posted in a conspicuous place 48 hours prior to the meeting with an agenda being attached. That includes any electronic medium that you might use--e-mails and broadcast.

Special meetings (which would include rules and regs changes). annual, special assessments, recalls, and Budget (which normally is done at the annual) meetings are required to be posted and notification of the membership , along with an agenda, require a 14 day notification. Same to include any electronic notifications.

ALL MEETINGS ARE REQUIRED TO BE POSTED AND TO INCLUDE AN AGENDA AND ARE OPEN TO THE ENTIRE MEMBERSHIP .

Do you have to have to send out proxy forms for a general BOD meeting?

No Proxy forms are only sent out for annual, election and amendment change meetings where a vote by the entire membership is required. They are also valuable to obtain your required quorum number for these meetings.

General or monthly meetings do not require proxies as there is no quorum requirement for these working meetings. (Sometimes we have 10 show ups out of 565 members for monthly meetings)

And of course, that is ONLY if your documents allow for the use of proxies.

Donna,Thank you for your time and advice,some of us count on your knowledge and experience to set us straight...i live in a coa and i must admit i think our board is doing a wonderful job and realy care about getting things done right.But on the other hand i don't think our management company advises our board correctly some times so i get confused on what the statute says and what goes on in our meetings,like our last meeting the board voted to fire the security guard after 2 years, install cameras and repair the gates.the gates 15000.00 the cameras 16000.00 and the guard was 40,000 they talked for 3 hours and about everthing from changing rules to gettin someone else to do the background checks for renters because our management company is charging 100.00 per tennant and 50.00 for each person over 18 and they voted to put somethings off until next meeting..I was confused because i ask are there no rules and regs on what the security guard was supose to do ,he use to lock up everthing at night and open everthing up on the weekends and i was told that the last board did things different and this board is going to get it right..my problem is the same management company is advising this board that advised the last board and they did'nt inform or keep up with the R@R that were amended or changed.So thats why i have to seek the opinion of you pro's and i thank you for taking the time to educate us on what has taken you so long to learn..Thanks Kevin..

Paul ,I dont know how P.A. statutes work but in FL. 720 HOA and 718 COA so i ask those that know about FL. all who live in FL. have the same Statutes that have to be followed so just because the docs say something does'nt mean its right not in FL. But others can explain this better than i,thats for sure...Thanks,Kevin

Donna we need a meeting for a urgent matter that requires a vote. We notified all the residents via flyers in doors. As far as I can tell this is OK sometimes things come up like this and you need a vote. So it can be done?

Yes, you can post it and because every household was notified per the flyers, it is legally posted. I hope that you stated the purpose of the meeting on the postings. Is this a Board vote?
