I live in a small incorperated town in N.C. We have zoning regulations and the initial developer sold the land in "subdivisions" and established covenants but no HOA has ever been established. There are differences between the Zoning Ordinances and the convenant restrictions. Which prevail and how are they enforced?

Not a lawyer - and not from N.C.... so someone else may be better versed in the laws there - but here in the wild west.... There could be communities which have covenants and no HOA - depending on how the CC&Rs are written, they are filed against the land, and it is the neighbor's responsibility to enforce, if a neighbor who is also under those CC&Rs is in violation. There use to be Landscape Maintenance organizations out here that did not have the same level of governance as HOAs... Get a big cup of coffee and start reading all the way through the documents and see if they call for a board, what that board is to do.
