Hi Everyone, my BOD has found a homeowner using AIRBNB,VRBO,ETC which is a direct violation of the Declarations. I was curious if anyone has had same experience and if so do you have any recommendations on how to contact these big corporations to have them on notice that this is a violation of my HOA? Thanks !!

One should look up the owner of the home at the county tax assessor site, and send the owner a polite letter to stop violating xyz covenant. Alternatively, ask the board to enforce the covenant.

Document the violation to the greatest extent possible.

Additionally, there is another link at the bottom to report a neighborhood concern.

I don't use the site so I can't say which would be best for your issue.

You may need a link to the advertisement to aid the company in helping the Association.

Air BNB, VRBO and others may choose to help, but are under no obligation to do so. The covenants are a contract between the owners and the companies that facilitate short term rentals (STR) are not a party to that contract. Code enforcement and other governmental organizations also do not enforce HOA covenants or rules, only local laws.

How do you handle other violations? Do you fine or just send warning letters? STR violations should be handled just like any other violation.

Does your HOA have a hearing policy and fining schedule? Your decoration, no doubt, says that Ownrs must comply with the restrictions in it, or else. What is the "or else" in you HOA?

Yes, following CA statutes ns our declaration, our HOA has called such Owners to hearings and our Board has fined them.

You send a letter to the owner of the home, summon them to a hearing and fine them. In addition, you contact ABNB and inform them the property that is listed is in an HOA and one of the
covenants is that all leases are a minimum of X days. ABNB will delist the property.

Our governing documents do not restrict short term rentals; however, our board had their attorney write a cease and desist letter to a homeowner who was operating one. The board even contacted the sites where the rental was advertised. Here is the caution: a homeowner could take legal action against you for interfering with their business. The hosting site has no role in enforcing HoA restrictions.
