Our property had potable water and sewer issue and is in the works to replace plumbing. I am not able to rent under those conditions with people coming in and out anytime with very little notice.

I allowed an unemployed family friend to stay while it's been fixed, I got a violation and explained verbal and written, offered to provide his drivers L for background check, never got a message. The project was back forth to start.

It's been almost a year I thought they understood, until they waited for the project to be finished my unit completely damaged to come a refer me to the violation committee. Is this legal?

Most of us aren't attorneys- why haven't you asked your private attorney?

And where did the violation come from - if it's from the city or county, you may need to suck it up and pay because a home without running water and drinkable water is a health hazard. You knew that - why else did you think you were told you couldn't rent it out? It wouldn't matter if you didn't charge the unemployed friend rent.

A couple of questions. Were there supposed to be residents in the building while the pipes and sewer connections were being replaced? Or were all residents displaced during this time?

Second, what exactly was the violation for? Did you have an unauthorized tenant (even if they weren't paying) in your unit? Does your association have rules about background checks and lease approval and you didn't check with them first?

Our association has the right to do background checks and tenant approvals. If you had a tenant in a unit without association approval we would have given you a violation also.

When you got the violation, did they give you time to get the person out? What are they asking you to do now?
