I am thinking of running for our board. Unfortunately there is an ongoing lawsuit against one of the owners and other things I don't know much about.

Does the current board need to disclose what is going on once I am a candidate or after I am elected? Also, can I withdraw my candidacy or from the board after the board tells me what is going on?

SusanS29, I advise going to the courthouse and asking the clerks to help you look up the lawsuit. Chances are good that you can read exactly what the lawsuit is about.

Also sometimes a summary of a lawsuit is available to the public online.

For candidates and owners, the current board should not do more than maybe talk about a lawsuit in general terms. This is because the board has a duty not to reveal to the defendant the HOA's strategy. More on this appears at https://www.davis-stirling.com/HOME/D/Disclosure-of-Lawsuits
