The second link may be of particular interest because it appears HOAs have filed fewer foreclosure cases since the state passed a law designed to protect people who are disputing something with their HOA. Enjoy!

Interesting article and the main takeaway for me is when said Mr Paymah said,

"In his testimony, Paymah, whose company bought the Rock Ridge condo in 2018 as an investment and has since rented it out, admitted that he had not been as attentive to property-related matters as he should have been for several years, as he dealt with a custody dispute over his son."

It is this kind of B.S and attitude that hurts HOA's and their paying homeowners. I'm all for fair foreclosure laws but when they go too far and protect the deadbeats then I'm not.

In my 5 years as board treasurer, the board and I worked hard to differentiate between the deadbeats and folks who were trying but ran into a bad financial patch with job loss, loss of spouse/significant other to death, divorce (and other stuff), medical bills and the like, vs. the deadbeats. Those made my head hurt - even today, I think I have a little PTSD thinking about one who gave everyone fits because she was acting contrary when I moved to the community. Don't know if she's still a resident (I think our attorney finally got the mortgage company to step in).

I don't think foreclosures should result from things like CCR violations because it's too easy to abuse (and sadly, some HOA boards have done just that). That's one reason why I prefer alternative dispute resolution for that type of thing, preferably something that's affordable. Delinquencies are another matter - if you aren't adult enough to come forward and be honest about your situation, I'm not going to spend a lot of time wondering what the problem is. If you'd rather tell your story to the facility attorney, go ahead, but don't think you can get away with paying pennies when everyone else is paying tens and twenties.
