Good Morning Everyone,

Our development still owns our interior streets, but some time ago we were able to persuade the town to take over their maintenance (repair, replacement, snow removal, lighting, curbing)

However, the Ordinance was not clear on signs and street painting.

I am of the opinion that maintenance should include those items as well, or at minimum be reimbursed to the HOA as these are services we also pay for in our tax dollars for the municipality.

Any thoughts or experience (even out of NJ) is appreciated.

Kind Regards,

Cliff

I would talk to the city and find out what they think the ordinance includes.

Do you realize your HOA will probably have to lawyer up to attempt to enforce this position?

I am working with one of the Members of the Town Council. I was just curious if anyone else had any experience with their towns regarding this.

That's great. If the Town Councilor sees this as you do, maybe the land use department and town attorney will take another look at this.

*Update
After several months of back and forth, the Town has conceded that the maintenance of our streets, signs, curbing, repaving, repairs, snow etc is their responsibility. After 15 years I don't blame them, I blame the previous HOA administrations for dropping the ball. Thank you, everyone, for your advice, as always.

Thanks for the update. It's always interesting to see how these things turn out, and also good for the archives so when people find the threads in the future they can get the entire picture.
