Our Covenants state RROO are to used to conduct meetings. At Our Annual meeting, one member motioned for a vote of acclimation for the current board. There were no names or qualifications given. The motion was quickly seconded and a vote immediately taken. There was never a report from the nominating committee and no discussion was allowed. The vote was not unanimous. There was no call for nominations from the floor. This to me is an illegitimate board. What can we do about this

RROO must mean Robert's Rules of Order. The acronym, though, is RONR (Robert's Rules of Order Newly Revised). More important than it are your Bylaws. Do they require a report from the Nominations Committee? Do they permit nominations from the floor (nominations AT the meeting)?

Did Owners receive any information about this annual meeting & election in advance of it?

Obviously, the time to speak up was at the meeting.

If you desire to challenge the results of the election, you will likely need to consult a local attorney on the legal options and costs associated with bringing legal action.

Typically, a vote of acclamation indicates that there were an equal number of candidates for the available seats.
If your Bylaws or applicable State statutes do not require nominations from the floor, then what occurred will likely withstand a legal challenge.

If you win a legal challenge, the Association will have to hold another election and follow the proper procedure. This may or may not change who is elected to the board.

Our bylaws do state you have to have a nomination committee and they must present the names and qualifications of the candidates. They did appoint a committee, but at least one of the members on that committee was voted on. They never gave the names of those to be voted on or their qualifications.

We received notification of the annual meeting but the agenda had no nominations attached as the bylaw require beforehand.
