HOA is suppose to create a community where owner-residents enjoy a safer, better life style, run by the residents to protect their property values and safety. But, that is not how it ends up. One would expect HOA board, being also owner residents, to have the best interest of the community at heart, follow the wishes of other owners, and with respect. But they don't. It's all politics, ego, power over others, and in many cases they get personal gain from being on the board. Just as it is in national politics. HOA is a gov within the gov, but with much more repressive dictatorial powers that may not be evident just from their Condo Documents, which they can and do change without notice. When you move to a HOA, you sign away much of your constitutional rights, and are under the rule of a tyrannical board and there is very little you can do against them. Sue, some say. Really? HOA wins the vast majority of the time, and in most cases you don't even have a legal standing because the laws favor them. Have you tried finding a lawyer to represent you? 90% of them are retained by the HOAs. One of the biggest scams, ever, but you don't hear the politicos standing up for your rights and changing the laws. In a democracy, HOA should not even be allowed with their absolute powers to run your life, power to decide what you may do, even what repairs you need, to force enter your residents, have a screening comity as to who may live there, permission required to even list your home for sale, power of taxation (aka: monthly fees, assessments, fines). But, as the saying goes, people get the government they deserve. Just how many don't care enough to stand up and vote them out, in HOA and nationally, how many don't even vote at all, they just take what comes.

No one forces anyone to buy into any HOAs. True there are good ones and bad ones out there just like everything else. Anyone who invests in real estate which is usually one of the biggest purchases of their lifetime should do the research. You need to understand the rule and restrictions. The HOA elects the board that makes decisions on behave of the community. You all pay dues to cover the day-to-day expenses and future expense of the association. The board is tasked with enforcing the rules that were put in place by the developers. I can say that in almost all cases not every rule makes 100% sense, but developers make it hard to make changes.

The thing that makes HOAs slightly better than the government is that it is easier to replace bad board members than bad politicians.
Not everyone should live in an HOA the problem is many people do not realize until after they purchase that HOA life is not for them. It is not the HOAs fault when this happens in my opinion it is the owners.

Tom, do you understand that buying into a HOA includes full disclosure that you are agreeing to covenants, and these covenants are lawful, contractual terms? Do you want to outlaw people's right to become a party to a contract?

HOA Boards may be voted out and/or recalled. This is a power reserved exclusively to the owners.

If I may ask, where did you get this idea from?

Associations maintain the common area and, along with members, have the authority to enforce the covenants.
Some Associations also provide specific services like trash/recycling pick up or yard maintenance.

That is all they do.

It's clear to me what the problem with HOAs is: it's people behaving like people. Our species has spent most of its existence trying to curb the worst of our behaviors so that we can live in groups without murdering each other, and you see how far we've gotten. Frankly, the fact that HOA board meetings in this country seldom result in gun fire is actually encouraging.

Disagree the fact that almost every year board members are murdered is not encouraging.

Lots of realtors probably promote this false hoa idealism

You left out a major part of the problem. Apathy in HOA's runs rampant and nobody wants to step up, get involved and help fix the problems. I agree that condo communities are especially troublesome because the owners rely on the HOA to maintain the roof over their heads and most of the physical structure. When these HOA's don't have their act together it can be a disaster. Despite this owners don't want to ante up and increase dues to cover basic expenses needed to maintain the infrastructure. They sit on their ass and watch things do down hill all the while blaming everything on the Board.

Obviously there are situations where the Board is also a large part of the problem. Personally, I will never buy in a condo community. At the end of the day, we all make choices where we want to live and if you want to live in an HOA you better do your homework before you buy.

Realtors don't care about informing the buyer about anything. They coverup the bad and promote the good about a property so it will sell. Do not count on any honesty, any guidance that will benefit you as a buyer from realtors. No realtor ever mentioned the huge downside of HOA, but they will brag fake news about how it is a great community working together for owners. All about making a large commission and a quick deal. They don't care about you. Just as the lawyers.

That is not the realtors job. You have expectations of others that just do not exist. The Realtor is not responsible for your education of HOAs. They can help guide you to the right resources but not their job.

I overall think you do not have a grasp what a HOA is or does. Your always going to be disappointed in the results because they will never meet your expectations that do not exist.

One issue I see in HOA resales is realtors saying things that are not accurate. I am not saying they lie but that they do not understand how much things vary from HOA to HOA or the have no experience with HOA's so they do not know how they operate. I once say a listing for a home in our association and the MLS had the wrong dues listed. I called the realtor and told her the proper amount. She never changed the MLS.
