Our CCRs state that a property owner judged delinquent in paying the annual assessment (i.e over 60 days late) is not allowed to vote in elections, member meetings, amendment votes, etc. Does the following section in the Texas Property Code void this policy?

Sec. 209.0059. RIGHT TO VOTE. (a) A provision in a dedicatory instrument that would disqualify a property owner from voting in a property owners' association election of board members or on any matter concerning the rights or responsibilities of the owner is void.

This section does not apply to a property owners’ association that is subject to Chapter 552 (Public Information), Government Code, by application of Section 552.0036 (Certain Property Owners’ Associations Subject to Law), Government Code.
