MD HB 107 requires reserve funding requirements to be done by October, 2023 if not yet done (updated every 5 years). We have a very small common area that we know will need to be included in the reserve study but we also have 40 plus acres of woods which is conservation land and backs up to some of the homes plus we have a ravine that runs between two homes and the back of some of the homes. The County this past fall did alot of work in the ravine between the two homes as erosion was encroaching towards the County Rd which is the main road in the neighborhood (49 homes). My question is does the reserve study need to include the property in the woods and the ravine?

I would assume if the association had to fund its maintenance. If the county were responsible, I wouldn't think so.

If that's association land, you may have some obligations. If you find nothing about it in your CC&Rs, you may want to check the county recorder's website/office to see if there are any legal agreements that speak to this. Search on your association's name to find the recorded agreements. (We found out the hard way that recording an agreement is considered disclosure in my state, and buyers may not be informed of these before signing the closing documents.)

I doubt the county would do work on items that were not their obligation.
You might need to check with someone at the county level to see who has the storm water management responsibility.

I know that when I lived in Fairfax County, the County took care of the main storm water management because they were afraid that HOAs would not.

You should consult with a civil engineer and surveyor to determine who is responsible for what. You should go to the County Recorders office and look at the plats.

Your Reserve Study should list all that.
