when its dark no one can see the truck anyways. Shouldn't it logically be during the day time hours?
My take aways:
1) Member admitted he never thought there would be a rule - meaning he didn't bother to read his governing documents even though he lived there for 27 years.
2) It's not known if this rule is in the covenants or somewhere else (makes a difference)
3) In the
referenced case, that association had an outright ban. This association isn't banning the vehicle - they are saying it has to be parked in the garage. Hence, it's not known if the case is directly relevant or not to the courts.
4) The member said the rule needs to change but the reporter didn't even go into how to change rules like this, instead he interviewed an attorney and discussed a court case - because explaining how to change the rules doesn't attract the viewers
5) Your topic title is misleading. The Association has a ban on all trucks and was simply enforcing it on this one. Make and model is not relevant.
6) The main reason, in my opinion, this is an issue at all is that the member stated that there is no room to park the truck in his garage - if there was it likely wouldn't be a news story.
I also agree with the others. This is not the forum to
continually post HOA horror story after horror story.
