I moved into a very small POA with 35 single family homes 12 years ago. At that time only one vacant lot existed. That lot has been completed 5 years ago. All the owners were very friendly and enjoyed sharing chores like replacing light bulbs or clean up after hurricanes. We had community B-B-Q's down here where I live in the col-der-sac.
All that changed 2 years ago with one family from New Jersey moved in. Now three management companies, lawsuits, complete change in board members, Insurance rate hikes, property values down because of buyers' disclosure information. It's been insane with email complaints every day or so totaling over a 1,000. we have had enough with this guy!!!
The board is at a loss with lawyers and the current management company saying quarterly fee going from $330 to possible $2000 from this guy's consent extortion tactics.
Does anyone have idea which path we need to go down beside closing the POA?

Why knee jerk reacting to lawsuit threats? Stop letting him do that. Gives them power. Look at worst case if they sued. Which is in your insurance policy. Do not keep running scared or to a lawyer.

I'd have to know more of the situation before opining. How did 35 owners vote in a complete change of board members? And insurance rates have climbed for everyone, has your POA filed claims that have justified the rate hike? Ours increased by $100K but we had hurricane damage. And is there data in the buyers' disclosure information that is false, or is it accurate and that has lowered property values?

I assume the dues going up because of the lawsuit threats and lawyer costs. The HOA has to pay those. That is why need more details if these are threats of lawsuit or actual ones. I do not bow down to empty threats...

Our property manager has taught me that e-mails can be ignored if desired.

1,000 e-mails to the Board is excessive. Just ignore them.

when someone buys a home, many state laws require a disclosure statement showing the health of the HOA, if it has enough reserves, if there are any lawsuits, etc.

I'm guessing there are exsisting lawsuits that scare new home buyers?

Thanks, Wendy, I do know what a disclosure statement means & it's also required in CA. I guess I want to know what's in it that this buyer is using as some sort of weapon.

I would hope that every property owner knows what a disclosure is. As an owner, past Board member and a Florida Licensed Realtor, I too would like to know more about the this Disclosure Statement that has caused property values to go down. I would like to see the Disclosure. What is the proper address of the related property. As a Realtor, when I list a house the Disclosure is put on the MLS with other documents.....
